STACKSSTACKS HOSTING TERMS OF SERVICE
1. Agreement to Terms
By accessing and using STACKS Hosting ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
STACKS provides container hosting services allowing users to deploy and manage containerized applications. Services are provided "as is" and "as available" basis.
3. Account Registration
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must be at least 18 years old to use the Service
4. Acceptable Use Policy
Prohibited activities include but are not limited to:
- Cryptocurrency mining without explicit written permission
- Hosting or distributing malware, viruses, or malicious code
- Operating botnets or participating in DDoS attacks
- Hosting content that infringes on intellectual property rights
- Illegal activities under US law
- Excessive resource usage that degrades service for other users
- Attempting to access other users' data or containers

5. Payment Terms
- Billing Structure: Services are billed monthly at flat rates
- Payment is processed automatically via the payment method on file
- You are responsible for all charges incurred under your account
- Additional storage volumes are billed separately at flat monthly rates
- Partial month usage is prorated
- Refunds are provided at our sole discretion
- Prices may change with 30 days notice via email
6. Data and Content
- You retain all rights to your content
- You grant us license to store and serve your content
- We are not responsible for data loss - maintain your own backups
- We may delete data 30 days after account termination
7. Service Level and Support
- We strive for 99.9% uptime but do not guarantee it
- Support is provided via email during business hours
- Emergency support available for critical issues
8. Privacy and Security
Your use of our Service is also governed by our Privacy Policy. We implement reasonable security measures but cannot guarantee absolute security.
9. Termination
- We may terminate or suspend your account for Terms violations
- You may cancel your account at any time
- Upon termination, your right to use the Service ceases immediately
10. Disclaimers and Limitations
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
- We disclaim all warranties, express or implied
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by you in the past 12 months
- Some jurisdictions don't allow limitation of liability
11. Indemnification
You agree to indemnify and hold harmless STACKS Hosting from any claims arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
